Terms and Conditions

 Please read this document carefully and keep it in a safe place as it sets out the terms and conditions (the “Terms and Conditions”) of the MBNA Canada TRAVELONLY travel reward program (the “Program”) for the MBNA Canada credit card account (the “TRAVELONLY Credit Card”) that is eligible to earn and accumulate TRAVELONLY reward points (“TRAVELONLY Points”).  Each Customer (as defined below) is automatically enrolled in the Program at no additional cost.  However, certain eligibility criteria (described below) must be met in order to earn TRAVELONLY Points under the Program. 

It is important to note that the Terms and Conditions set out in this document (i) relate solely to the Program; (ii) supercede any and all previously published terms and conditions relating to the Program; and (iii) are separate and distinct from the terms and conditions relating to the TRAVELONLY Credit Card.

 1.        Definitions.  In addition to the terms defined above or elsewhere in this document,

 “you”, “your” and “Customer” mean any individual who is a cardholder or a joint cardholder of the TRAVELONLY Credit Card;

 “Account” means the account maintained by TRAVELONLY that records all TRAVELONLY Points earned by the Customer from eligible TRAVELONLY Credit Card transactions and promotional programs in connection with the Program;

“TRAVELONLY” means TRAVELONLY INC.; and
“MBNA” means MBNA Canada Bank.

 
2.        Acknowledgement.  The use of your TRAVELONLY Credit Card will constitute your acknowledgment of and agreement with each of the Terms and Conditions described in this document relating to the Program.

 
3.        Participation Eligibility Requirements.   To be eligible to participate in the Program (i.e., both earn and redeem TRAVELONLY Points), you must satisfy each of the following conditions:

a)     be a Customer in good standing with an TRAVELONLY Credit Card that has active charging privileges;

b)    be a member in good standing of the Program;

c)     be an individual (corporations, partnerships, and other entities may not participate); and

d)    reside within Canada .

 
4.        Program.  The Program offers rewards in the form of TRAVELONLY Points that are credited to your Account.  TRAVELONLY Points awarded under the Program have no cash value.  Instead, TRAVELONLY Points are accumulated and redeemable in the manner described below.  It is the sole responsibility of the Customer to determine the then applicable terms and conditions related to the Program including, but not limited to, accumulation, redemption and expiration of TRAVELONLY Points.

 
5.        TRAVELONLY Points Accumulation.  TRAVELONLY Points are earned and accumulated to your Account in the following manner:

a)       Ten (10) TRAVELONLY Points will be added to your Account for every new one (1) (Canadian currency equivalent) dollar (CDN$1) in Net Purchase transactions. Fractions of dollar values of new Net Purchases will be rounded to the nearest whole dollar.  In addition, from time to time, you may have opportunities to earn incremental or bonus TRAVELONLY Points through special offers that will be accompanied by specific rules.  “Net Purchase” means the purchase of goods and/or services made by you or your authorized user(s) through the use of your TRAVELONLY Credit Card, plus or minus any adjustments made to your TRAVELONLY Credit Card in respect of those purchases.. Net Purchases do not include, and you will not earn any TRAVELONLY Points in respect of, interest charges; cash advance transactions (including credit card cash advance cheques, balance transfers and bank or automatic bank machine disbursements); balance(s) permissibly transferred between MBNA credit card accounts; cash advances re-designated as purchases; the purchase of money orders, wire transfers, bets, lottery tickets, or casino gaming chips; unauthorized charges (including those made with a lost, stolen, canceled or fraudulent TRAVELONLY Credit Card); credit insurance premiums; over-the-credit-limit fees; and other fees and charges assessed on your TRAVELONLY Credit Card.

b)       TRAVELONLY Points will be posted to your Account approximately once every month promptly after each billing cycle of your TRAVELONLY Credit Card.  TRAVELONLY Points are not earned and available for redemption until they are posted to your Account.

c)       TRAVELONLY Points indicated on the monthly TRAVELONLY Credit Card statement reflect only those TRAVELONLY Points accrued during the previous billing cycle and do not reflect cumulative amounts or redemption of TRAVELONLY Points.

d)       If any TRAVELONLY Credit Card transaction that is subject to a billing dispute is credited to your TRAVELONLY Credit Card, the TRAVELONLY Points value of that transaction will be immediately deducted from your Account. However, if the disputed charge is reversed, then the TRAVELONLY Points value of the transaction will be added back to the Account.

e)       The TRAVELONLY Points value of a transaction will be deducted from your Account balance when a credit is posted to your TRAVELONLY Credit Card for adjustments made for previously billed charges.

f)        There is no limit on the number of TRAVELONLY Points that can be accumulated on an Account.

g)       TRAVELONLY Points cannot be used in partial or total payment of your TRAVELONLY Credit Card.

h)       For new Customers, accrual of TRAVELONLY Points will begin on the date on which your first retail purchase is charged to your TRAVELONLY Credit Card. If you are already an MBNA customer and you convert your existing eligible credit card account to the Program, you will not begin accruing TRAVELONLY Points until your TRAVELONLY Credit Card account has been created by MBNA and you make your first retail purchase with your TRAVELONLY Credit Card. TRAVELONLY Points will not be awarded retroactively.

6.        Account Information.  TRAVELONLY will be solely responsible for maintaining TRAVELONLY Points accumulated under the Program.  Customers will receive regular detailed information about the status of their Account.  Customers may also contact TRAVELONLY (as detailed below) to make inquiries about the Program and/or their Account.

7.        TRAVELONLY Points Inquiries/Redemption Centre.  In order to redeem TRAVELONLY Points or to make inquiries about the Program and/or your Account, Customers should contact TRAVELONLY by:

The TRAVELONLY Customer Service Centre operates from Monday to Friday between 9 a.m. and 5 p.m. (E.S.T.)

 

 

 
8.        TRAVELONLY Points Redemption.

All redemptions of TRAVELONLY Points can only be made through TRAVELONLY.  TRAVELONLY Points cannot be used in conjunction with any other travel service provider.  MBNA is not responsible for the redemption of TRAVELONLY Points and/or the management of the Program and the Customer agrees to release MBNA and its affiliates from any and all claims in respect of damages or losses they may suffer due to non-compliance with the Terms and Conditions of the Program and/or any redemption policies. 

The procedure for redeeming TRAVELONLY Points is as follows:

(a)     Customers are responsible for making all travel or other purchase arrangements through TRAVELONLY. Reservations made in another manner do not qualify for TRAVELONLY Points redemptions and neither MBNA nor TRAVELONLY assumes any responsibility or liability for such arrangements.

(b)     TRAVELONLY Points are redeemable into a credit to be applied against the value of travel and/or related services purchased through TRAVELONLY.

(c)     Only the Card holder may redeem TRAVELONLY Points.

(d)     Every Thousand TRAVELONLY Points has a redemption value of one dollar (CDN$1.00) in Canadian funds (for example, One Thousand TRAVELONLY Point is redeemable for a credit of $1 against the travel purchase transaction).  For greater certainty, a redemption of TRAVELONLY Points will reduce the balance owing on your TRAVELONLY travel purchase transaction but otherwise does not affect any obligation you have to MBNA under your TRAVELONLY Credit Card.

(e)     The minimum number of TRAVELONLY Points required for redemption is 10,000.

(f)      Customers can redeem a maximum of 1,000,000 TRAVELONLY Points in connection with any single travel purchase transaction.

(g)     All applicable Federal and Provincial income or sales taxes, and other miscellaneous travel charges in connection with any travel transaction, including, but not limited to taxes, charges levied by the airline, airport or airport authority, security fees, departure fees, excess baggage charges, gratuities, insurance, priority ticket charges, and airline amenities are the sole responsibility of the Customer and are not included as charges eligible for a rewards redemption credit.

(h)    TRAVELONLY Points are not valid in combination with any other offers, discounts or promotions.

(i)     Any Common Carrier Travel Accident Insurance coverage available through your TRAVELONLY Credit Card will be applicable to any travel transaction paid for with redeemed TRAVELONLY Points provided a portion of the travel transaction is charged to your TRAVELONLY Credit Card. Please see the terms and conditions that you received with your TRAVELONLY Credit Card for details.

9.        Travel Services.  All travel related services will be provided by TRAVELONLY. MBNA shall not be liable in any way for any losses, costs, damages, expenditures or other claims resulting from or arising in connection with your participation in the Program, including without limitations those arising in connection with any travel related services.  Any travel product or service that Customers acquire through TRAVELONLY creates a contractual relationship between the Customer and the Tour Operator / Travel Supplier. TRAVELONLY acts as an agent for the Tour Operator / Travel Suppliers who provides the Customer with travel products or services purchased through TRAVELONLY.  TRAVELONLY is careful to select Tour Operators and Travel Suppliers that are reputable, however, be advised that under no circumstances does TRAVELONLY accept legal responsibility or liability for dissatisfaction or complaints related to the product or services provided by Tour Operators / Travel Suppliers.  For more information regarding the terms and conditions governing the contractual relationship with a Tour Operator / Travel Supplier, please refer to the information contained in Tour Operator / Travel Supplier brochures or their respective terms and conditions. Customers are strongly encouraged to review and understand this information, and inform themselves of the terms and conditions governing their contract with a Tour Operator / Travel Supplier. Customers requiring assistance in obtaining this information can contact a TRAVELONLY representative.

 
10.     Tax.  Each Customer is solely responsible for any personal tax liability arising from their participation in the Program.  You should consult with your personal tax advisor in order to determine any personal tax consequences.  You understand and agree that neither MBNA nor TRAVELONLY will issue tax receipts in respect of the Program.  You hereby agree to release MBNA, TRAVELONLY and their respective affiliates from any and all claims in respect of any tax liability resulting from your participation in the Program.

 
11.     Interpretation and Disputes.  Any interpretations, questions or disputes regarding the Program shall be resolved at the sole discretion of MBNA and TRAVELONLY.  All decisions made by MBNA and TRAVELONLY shall be final.

 
12.     Privacy.  You consent to and authorize MBNA, its subsidiaries and affiliates and any nonaffiliated third parties with whom any of the foregoing contract in order to manage the Program, to share information about you, your TRAVELONLY Credit Card and the Program as necessary to effect, administer, enforce, service or fulfill the terms of the Program.

 
13.     Amendments to Program.  The Program and its benefits are offered at the discretion of MBNA and TRAVELONLY. You understand and agree that MBNA and TRAVELONLY may at any time, with or without notice, change these Terms and Conditions in whole or in part including, but not limited to, the conditions of participation in the Program and the accumulation of TRAVELONLY Points. You further understand and agree that any change may be implemented by MBNA and TRAVELONLY even though such change may affect the accrual value of TRAVELONLY Points already earned.  

 
14.     Termination.  Either MBNA or TRAVELONLY may suspend or terminate the Program at any time upon ninety (90) days notice to you.  Any violation of the Terms and Conditions by you may result in liability for damages, termination of your Program eligibility and/or loss or revocation of TRAVELONLY Points.

 
15.     Transfer of TRAVELONLY Points.  TRAVELONLY Points are not transferable in any circumstance including, but not limited to, upon death or as part of any domestic relationship’s legal proceedings or otherwise.

 
16.     Disqualification/Forfeiture of TRAVELONLY Points.  

a)       A breach of these Terms and Conditions including, but not limited to, fraud or abuse in the earning or redemption of TRAVELONLY Points may result in forfeiture of accrued TRAVELONLY Points, cancellation of a Customer’s participation in the Program and/or cancellation of the Customer’s TRAVELONLY Credit Card.

b)       If you voluntarily close your Account and/or TRAVELONLY Credit Card, unredeemed TRAVELONLY Points may be redeemed if your redemption request was received prior to receipt of your notice of cancellation. If your request is not received prior to your notice of cancellation, unredeemed TRAVELONLY Points shall be automatically, immediately and irrevocably forfeited.

c)       If MBNA cancels your TRAVELONLY Credit Card, whether due to fraud, abuse, nonpayment, non-renewal, death or for any other reason, all unredeemed TRAVELONLY Points shall be automatically, immediately and irrevocably forfeited.

 
17.     Waiver.  No delay or omission by TRAVELONLY and/or MBNA in exercising any right or remedy contained in these Terms and Conditions shall operate as a waiver of any of such rights and remedies nor shall it be interpreted as such.  TRAVELONLY and/or MBNA may, in their sole discretion, deviate from the strict observance, performance or compliance by the Customer of any of these Terms and Conditions.  Such deviations shall not alter, affect or prejudice any of TRAVELONLY and/or MBNA’s other rights or remedies and shall only be effective in the specific instance and for the specific purpose for which it was given and shall be deemed not to be a waiver of any other of TRAVELONLY and/or MBNA’s rights or remedies as a result of any other breach of these Terms and Conditions.

 
18.     Indemnification.  You agree to hold MBNA and its directors, officers, agents, employees, affiliates, successors and assigns (collectively, the “Indemnitees”) harmless from and against all liability, causes of action, penalties, costs and claims, and will reimburse MBNA’s and the Indemnitees’ reasonable and actual expenses incurred in connection therewith (including legal fees and costs), arising from or related to your participation in the Program and/or the Program including, but not limited to, any delay, rescheduling postponement, cancellation or failure to honour for any reason whatsoever any travel arrangements or other products or services promised to you upon the redemption of TRAVELONLY Points, and any damages, injuries or disabilities suffered during a travel reward trip, hotel accommodation or through use or installation of any other reward. You further agree that MBNA has no liability to you in respect of TRAVELONLY Points. You agree that any recourse you may have in respect of a failure on the part of any person or entity, including a common carrier, to deliver the travel services or products promised under the Program shall be solely as between you and such other person or entity.

 
19.     Address Changes.  It is the sole responsibility of each Customer to promptly advise TRAVELONLY and MBNA of any changes to such Customer’s mailing address or other contact information. Neither TRAVELONLY nor MBNA is responsible for any lost, misdirected or delayed mail or other communications or any consequences thereof and you agree to release TRAVELONLY and MBNA and their respective affiliates from any and all claims in respect of losses or damages resulting therefrom.

 
20.     Not Affiliated.  MBNA and TRAVELONLY are not affiliated in any manner and are agents, representatives or employees of each other and neither party has the power to obligate or bind the other party.  The Program and the TRAVELONLY Credit Card are independent of each other.  MBNA makes no representation as to the quality or fitness for use of any rewards offered under the Program and neither offers, endorses, nor guarantees any of the goods, services, information or recommendations provided by third parties to you.
